六、被拆迁人有权选择补偿方式
征收拆迁中常见的补偿方式有:货币补偿、房屋补偿及两者相结合。法律赋予了被拆迁人自由选择补偿方式的权益。若是补偿方案或补偿协议中禁止对补偿方式进行选择或者仅提供单一的补偿方式,那么便是违法的。
七、先补偿后搬迁
无论是国有土地亦或是集体土地,都应当遵循先补偿后搬迁的原则来进行征收拆迁。在补偿款未全额到位的前提下而实施的强制搬迁都是违法的,被拆迁人可提起行政复议或是行政诉讼来维护自身的合法权益。
八、不能变相强迫搬迁
拆迁方对付“钉子户”时有可能使用暴力、断路、断水断电等方式变相强迫钉子户搬迁。而法律已经明确认定这些都属于违法行为,被拆迁人若是遇到这些情况应当及时报警处理,还可通过行政复议、行政诉讼等方式进行维权。
九、强拆必须由法院强制执行
在征收拆迁中,政府、行政部门等全部无权自行实施强拆,只能在达成补偿协议或作出补偿决定,补偿款项到位后才能向当地法院申请强制执行,由法院作为主体实施强拆。法院以外的政府行政部门所实施的强拆都是违法的,可依法追究其责任。
